Anti Piracy Cell

Anti Piracy Cell was formed by G.O (MS) no. 167/ 2011 Home dated 27.07.2011 and is functioning under ADGP Crimes. APC is headed by SP and the team includes one DySP, one CI and two SIs.

In India copyright protection is broadly conferred on six categories of works being artistic, literary, dramatic and musical works, and sound recording and cinematograph films. Related protection is conferred to performers and broadcasting organizations and authors are in any event entitled for protection. The source code of a computer program is treated as a literary work, with certain additional exceptions and specific fair use exceptions applying to it. Generally the term of copyright in a work is for a period of the life of the author plus 60 years. Now a day’s piracy has become a major problem due to rapid advance in technology. The object of the pirate is to make easier and quick money and avoid payment of legitimate taxes and loyalties. The Malayalam film industry was in a bad stage due to piracy. A huge amount of money in terms of tax evasion is also lost to government treasury. After the formation of the cell the theatre copy piracy came to a standstill. So far the cell has detected 77 cases throughout the state.

Activities of Anti Piracy Cell

The Anti Piracy Cell is working under the state CBCID as a central unit to coordinate collection of intelligence, creating data bank, to coordinate investigation and to directly investigate important crimes to trace out their original source and web distribution.

Type of Crimes Reported and Handled by Anti Piracy Cell

APC is investigating all type of Copy Right infringement cases. The cases investigated directly by the Anti Piracy Cell, CBCID are either by Government order, Court Order or by written order DGP/ADGP Crimes. Other cases detected by the cell are handed over to local police stations for further investigation.

For Public

You should be convinced that any CDs/DVDs displaying on footpath is original before buying. The original CDs/DVDs the following items like Censor certificate, warning, affidavit, MRP, Packing, date the address of both copy right holder and producer, emblem and the hologram etc will be fixed in both DVD and in cover While granting permission to stalls in festival places, carnivals etc the sellers of pirated CDS/DVDS should be avoided.


For Internet subscribers


Up loading and down loading of cinemas, songs or any item by violating the copy right act is a criminal offence and punishable. Sharing of viewing of films on internet sites is a criminal offence and punishable under I.T Act 2000 and copyright Act 1956. The computers used by children at home shall be place under the surveillance of parents. Parents should watch the activities of their children when they were using computer and mobile phones.


For Cable T.V Operators


Telecasting films by cable T.V net work without the consent of producer or copyright owner is offence and is punishable.
For Mobile shop owners. Do not write or copy any cinema/songs to any form of electronic storage device like CD'S, Memory a card, hard discs etc. without the proper consent of producer or copyright holder is offence and is punishable.
Storing or copying of indent pictures in pen drive or computer device is an offence as per sec. 67 of IT Act and Indian penal code sec.292 (IPC).


CD/DVD Distributors and lenders


It is compulsory to keep the bill with title name. Without proper copyright the holding, selling or giving or rent of items like CD/DVD etc is a criminal offence and is punishable.  Showing or Selling of any form of indecent pictures/films is an offence and is punishable as per indecent representation of women act.

 

Public Awareness Programs


Anti Piracy Cell is conducting awareness programs through Television, Radio and internet. Program includes punishments, Do’s and Don’ts to be followed by the General Public/Students, mobile shop owners, CD/DVD Distributors and lenders etc.
